On 11 October 2021 the Real Property Amendment (Certificates of Title) Act 2021 (NSW) commenced. It abolished certificates of title and the control of the right to deal framework.
All existing certificates of title were cancelled and no new ones are issued. A certificate of title no longer needs to be produced, and consent from the holder of the control of the right to deal is no longer needed, to register a dealing or plan.
For more information, see the NSW Registrar General’s guidance on the abolition of certificates of title.
